हाईवे गैंगरेप : फैसले के 127 पन्ने बयां करते हैं दरिंदगी की दास्तां

बुलंदशहर। हाईवे के हैवानों को आखिरकार उनके किए की सजा मिल ही गई। सोमवार को न्यायालय विशेष न्यायाधीश पॉक्सो अधिनियम ओमप्रकाश वर्मा ने पांचों दोषी अभियुक्तों को आजीवन कारावास और 1.81-1.81 लाख रुपये अर्थदंड की सजा सुनाई। इस गैंगरेप का 127 पेजों में न्यायालय ने फैसला लिखा।
घृणित कृत्य की भर्त्सना कीः अदालत ने ने फैसले में इस शर्मनाक, निंदनीय और घृणित कृत्य की जमकर भर्त्सना की है। करीब 9 साल से हाईवे गैंगरेप मामले में सजा पर न केवल पीड़ित पक्ष बल्कि प्रदेश और देशभर के लोगों की निगाहें लगी हुई थीं। हर कोई यह जानने को उत्सुक था कि आखिर हाईवे पर मां-बेटी से उनके परिजनों को बंधक बनाकर दरिंदगी करने वालों को क्या सजा मिलती है।
जुबेर को अतिरिक्त सजा सुनाई: सोमवार को दोपहर में न्यायालय द्वारा सजा का फैसला सुनाए जाने का मैसेज सभी जगह फैल गया। लोग इसकी चर्चा करने लगे। विशेष लोक अभियोजक वरुण कौशिक ने बताया कि अलग अलग धाराओं में न्यायालय ने सभी पांचों दोषियों को आजीवन कारावास और 1.81-1.81 अर्थदंड की सजा सुनाई है। एक दोषी जुबेर रको को आर्म्स एक्ट में दो वर्ष के कारावास की अतिरिक्त सजा सुनाई गई है। खास बात यह है कि अर्थदंड की आधी आधी धनराशि पीड़िता मां-बेटी को मिलेगी।

विशेष लोक अभियोजक वरुण कौशिक ने बताया कि न्यायाधीश ने अपने फैसले से बड़ा संदेश दिया है। अदालत ने घटना की गंभीरता को देखते हुए कहा कि सभ्य समाज से इन राक्षसों को दूर रखा जाए, ये जब तक जिंदा रहें इन्हें जेल में ही रखा जाए। न्यायालय ने इस घटना को शर्मनाक और घृणित कृत्य बताते हुए इसकी भर्त्सना की। एक दोषी जुबेर को आर्म्स एक्ट में दो वर्ष के कारावास की अतिरिक्त सजा भी सुनाई।

394, 395, 397 में 10-10 वर्ष की कारावास और 10-10 हजार रुपये अर्थदंड
120 बी में 20 वर्ष की कारावास, 50-50 हजार रुपये अर्थदंड
376 डी में आजीवन कारावास और एक-एक लाख रुपये अर्थदंड
342 में एक वर्ष की सजा और एक हजार रुपये अर्थदंड
4/25 आर्म्स एक्ट में जुबेर को दो वर्ष का अतिरिक्त कारावास
जेल में कड़ी निगरानी में रहेंगे पांचों अभियुक्त
सजा सुनाए जाने के बाद पांचों अभियुक्तों को जिला कारागार में कड़ी निगरानी में रखा जाएगा। जेल अधिकारियों के अनुसार किसी भी बंदी को सजा सुनाए जाने के बाद विशेष निगरानी में अलग बैरक में रखा जाता है। जेल अधिकारियों ने बताया कि बंदीरक्षकों को पांचों अभियुक्तों पर नजर रखने और उनकी गतिविधियों पर ध्यान देने के लिए कहा गया है। बीते कई सालों से पांचों अभियुक्त जिला कारागार में ही बंद है।

Everyone was eager to know what punishment would be meted out to those who committed this brutal act against a mother and daughter on the highway after holding their family members hostage.
Zubair given additional sentence: The news of the court’s sentencing decision spread everywhere on Monday afternoon. People started discussing it. Special Public Prosecutor Varun Kaushik said that the court sentenced all five convicts to life imprisonment and a fine of Rs. 1.81 lakh each under different sections. One convict, Zubair, was given an additional sentence of two years’ imprisonment under the Arms Act. Significantly, half of the fine amount will be given to the victim mother and daughter.

Special Public Prosecutor Varun Kaushik said that the judge has sent a strong message through his verdict. Considering the seriousness of the incident, the court said that these monsters should be kept away from civilized society and should remain in jail for as long as they live. The court condemned the incident as a shameful and heinous act. One convict, Zubair, was also given an additional sentence of two years’ imprisonment under the Arms Act.
Punishment and Fines Under Each Section
Sections 394, 395, 397: 10 years imprisonment and a fine of ₹10,000 each
Section 120B: 20 years imprisonment and a fine of ₹50,000 each
Section 376D: Life imprisonment and a fine of ₹100,000 each
Section 342: One year imprisonment and a fine of ₹1,000

All five accused will be kept under strict surveillance in jail
After the sentencing, all five accused will be kept under strict surveillance in the district jail. According to jail officials, any prisoner is kept in a separate cell under special surveillance after being sentenced. Jail officials said that the prison guards have been instructed to keep a close watch on the five accused and monitor their activities. The five accused have been imprisoned in the district jail for several years.
